GENERAL
The following terms and conditions will apply for all contracts and interactions between the customer and monom trademark registered for SC OBLIC DESIGN STUDIO SRL about the delivery of goods, which are ordered in our online shop found on the internet as www.monom.studio. SC OBLIC DESIGN STUDIO SRL is a company registered in Romania, Cluj-Napoca city, 10 Tulcea street. The company's fiscal registration number is 40716158, and the number for the Registry of Commerce is J12/832/2019.
2. ACCOUNT
2.1. The customer is responsible for maintaining the confidentiality of its account and password and for restricting access to its computer to prevent unauthorised access to its account. The customer agrees to accept responsibility for all activities that occur under its account or password.
2.2. The customer will make sure that the details which are provided to MONOM or SC OBLIC DESIGN STUDIO SRL are correct and complete. The customer shall inform us immediately of any changes to the information that has been provided at the time of registration.
3. PLACING AN ORDER AND CONTRACT
3.1. The customer places the order by following the next steps:
3.1.a. Select product(s) and “add to basket”.
3.1.b. Select “Continue Shopping” to add more products to the cart. To proceed with the purchase click on “Proceed to Checkout”.
3.1.c. Enter a promotional code in case you have one in the dedicated field. Keep in mind that promotional codes do not apply on discounted products and promotional codes, vouchers or discounts do not combine.
3.1. d. Enter all personal information and click on “Continue”, following every step.
3.1.e. Read your Terms of Use and agree with them if you agree and click on “continue”.
3.1.f. Choose shipping method and notify us with a message if there are any other details we should know regarding your shipment.
3.1.g. Choose your payment method and enter credit card details.
3.2.After placing an order, monom will send an email to the customer, which confirms receipt of the order and contains the details of the order. This email does not constitute the acceptance of the offer.
3.3. monom (SC OBLIC DESIGN STUDIO SRL) accepts the offer either by shipping the products to the address provided by the customer or by confirming the shipping by an email. The contract has not been concluded before monom (SC OBLIC DESIGN STUDIO SRL) has accepted the offer.
4. PRICES AND CONDITIONS OF PAYMENT
4.1. Shipping costs are not included. For detailed shipping costs, see 5.3.
4.2. The payment methods accepted are credit card and cash on delivery.
4.3. For payment we only accept the following credit cards: Visa, EuroCard/MasterCard.For deliveries inside Romania, we accept cash payment on delivery.
4.4. All credit card payment are processed by Netopia Payments (MobilPay) - https://netopia-payments.com/.
4.5. In case of delivery outside EU the customer is obliged to bear the customs duties and further costs incurred. Customs policies vary widely from country to country, so the customer should contact the local customs office for further information.
5. SHIPPING
5.1. monom products are designer pieces of jewellery, each piece is handmade in our workshop, each collection is produced in small series. please be aware that not all products are in stock and the production time for each is between 2 to 10 working days. Also, the pieces which need to be produced in accordance with your dimensions need the same production time.
5.2. All products in stock will be dispatched in 2 to 5 working days.
5.3. For products which are “out of stock” the delivery period can be up to 2 weeks in case of delivery inside EU. In case of delivery outside the EU, the delivery period can be up to 4 weeks.
5.4. If the customer orders several items and one or more of the ordered items are currently out of stock, we will not ship the goods until each of the ordered items is back in stock again. The delivery time in that case may take up to 2 weeks for customers within the EU and up to 4 weeks for customers who are located outside the EU.
5.5. The shipping costs depend on the customer’s location:
5.6.a. For deliveries in Romania, shipping costs are FREE for purchases over EUR 65 / 300RON, EUR 5,00/19 RON for purchases under EUR 65/300RON .
5.6.b. .For deliveries within the EU, shipping costs are 12.50 E/60 RON, FREE for purchases over 94 E/450 RON
5.6.c. .For deliveries outside the EU, shipping costs are 15.00 E/75 RON, FREE for purchases over 94 E/450 RON
5.6.d. The promotional codes and voucher codes cover the products expenses, they do not include the shipping. The shipping costs will be suported by the client and they will be estimated at the confirmation of the order.
5.7. Monom (SC OBLIC DESIGN STUDIO SRL) will not be held responsible for any delay or failure to comply with its obligations if the delay or failure arises from any cause which is beyond our reasonable control.
5.8. In Romania, the parcels are to be delivered by Urgent Cargus Courier - https://www.urgentcargus.ro/ and outside Romania (EU and outside EU) the parcels are to be delivered by DHL - www.dhl.com
6. RETURNS
6.1. In accordance with OUG 34/2014, the customer has the right to return new unworn or unused goods within 14 days. Goods should be returned in their original packaging where relevant. They are to be unused other than for the purpose of trying on for fit. If there is evidence to suggest that the goods have been used to a degree such as to decrease the value of the product, the customer loses his/her right to exercise a return. The 14-days-period shall begin to run after receipt of this instruction (e.g. via e-mail), but in any event no earlier than the goods have been received by the customer. In order to comply with the 14-days-period, it shall be sufficient for the products in question to have been dispatched as new and unused within this period.
6.2. In the event of the return of the products, any services and products received, and any profit derived there from, shall be returned.
6.3. Monom (SC OBLIC DESIGN STUDIO SRL) will only cover shipping costs incurred in returning the product(s) if the return is a result of our error.
6.4. We only refund the credit card that was used to place the order as obliged by law.
6.5. 7. TRADEMARK
7.1.The logo and the name “monom” are trademarked. They are not to be used in any way without our permission.
7.2. Monom (SC OBLIC DESIGN STUDIO SRL) owns copyrights and usage rights for all materials on the site.
7.3. Any copyright infringement identified on the website www.monom.studio can be reported to georgiana@monom.studio.
8. GDPR
8.1. Monom (SC OBLIC DESIGN STUDIO SRL) is entitled to collect, process and use our customers’ data in accordance with applicable data protection law.
8.2. Monom (SC OBLIC DESIGN STUDIO SRL) will only use the customer’s data for purpose which the data are provided for and/or for correspondence with the customer.
9. JURISDICTION AND APPLICABLE LAW
9.1. Any contract will be governed by the Romanian law.
10. PROMOTIONS, VOUCHERS AND DISCOUNT CODES.
10.1.Promo codes can't be used on already discounted products.
10.2.In case you have a discount code, it must be used directly on the platform. It cannot be applied to your order later or by phone.
10.3. Promotional codes, discount codes and vouchers do not combine. You can only use one of the mentioned codes for each order placed online.
11. Legal guarantee and after-sales service.
11.1. The products sold on our website benefit from the legal guarantee of conformity according to law 449/2003. Each product is accompanied by a warranty certificate, which also stipulates the care indications of the products.
11.2. The products sold on our website also benefit from refinishing and refreshment services, if needed. For more details, please see the page dedicated to the Refresh service.
12. COMPLAINTS AND DISPUTES
