1. GENERAL

These Terms and Conditions apply to all contracts, orders and interactions between the customer and MONOM, a registered trademark of SC OBLIC DESIGN STUDIO SRL, regarding the sale and delivery of products ordered through our online shop, available at www.monom.studio

By accessing or using our website and placing an order, the customer confirms that they have read, understood, and agreed to these Terms and Conditions.

2. CUSTOMER ACCOUNT

2.1. Customers are responsible for maintaining the confidentiality of their account credentials and for all activities carried out under their account.

2.2. Customers must provide accurate and up-to-date information when registering or placing an order.

2.3. MONOM reserves the right to suspend or delete any account containing false or incomplete information or suspected of misuse or fraudulent activity.

3. ORDERS AND CONTRACT FORMATION

3.1. To place an order, the customer must:

a) Select the desired product and add it to the shopping cart;

b) Complete the checkout form with personal and payment details;

c) Agree to these Terms and Conditions by ticking the confirmation box;

d) Choose the delivery and payment methods;

e) Confirm and submit the order.

3.2. After submitting the order, the customer will receive an e-mail confirming receipt of the order. This e-mail does not constitute acceptance of the order.

3.3. The sales contract is considered concluded when MONOM:

  • dispatches the ordered products to the customer; or
  • sends an e-mail confirmation of shipment.

3.4. MONOM reserves the right to decline any order in justified circumstances (e.g. out of stock, incomplete data, suspicion of fraud). In such cases, the customer will be informed, and any payment made will be refunded in full.

4. PRICES AND PAYMENT

4.1. All prices displayed on the website include VAT. Shipping costs are not included unless explicitly stated otherwise.

4.2. Accepted payment methods:

  • Online card payment (Visa, MasterCard);
  • Cash on delivery (Romania only).

4.3. All online payments are securely processed by Netopia Payments (MobilPay) – https://netopia-payments.com

4.4. For orders outside the European Union, the customer is responsible for any customs duties or import taxes. MONOM shall not be liable for delays caused by customs procedures.

5. DELIVERY AND SHIPPING

5.1. MONOM jewellery pieces are handcrafted in small series. Production time for made-to-order pieces is typically 2–10 working days.

5.2. In-stock products are shipped within 2–5 working days.

5.3. Estimated delivery times:

Up to 2 weeks within the EU;

Up to 4 weeks outside the EU.

5.4. If an order includes multiple products, they will be shipped together once all items are available.

5.5. Shipping costs:

Romania: free for orders over 300 RON; 19 RON for orders under 300 RON.

EU: €12.50 / 60 RON; free for orders over €94 / 450 RON.

Outside EU: €15 / 75 RON; free for orders over €94 / 450 RON.

5.6. Promotional codes apply to product values only and do not cover shipping costs.

5.8. The risk of loss or damage to goods passes to the customer once the parcel is handed over to the courier.

5.9. MONOM cannot be held liable for delivery delays caused by courier services or external circumstances beyond our control (weather, holidays, force majeure).

6. RETURNS

6.1. In accordance with EU Directive 2011/83/EU and Romanian law (OUG 34/2014), customers have the right to withdraw from the purchase and return unused products within 14 calendar days from the date of delivery.

6.2. Returned products must be unused, undamaged, in their original packaging, and accompanied by all relevant documents.

6.3. Exceptions: Custom-made or personalised items cannot be returned unless defective or non-compliant.

6.4. If the return is due to an error by MONOM, shipping costs will be covered by us. Otherwise, return shipping will be deducted from the refund amount.

6.5. Refunds are processed within 14 days after receiving the returned goods or proof of shipment:

  • For card payments: refunded to the same card account;
  • For cash-on-delivery orders: refunded to a bank account provided by the customer (same name as on the invoice).

6.7. In case of refused delivery, the customer will be refunded after the parcel is received by MONOM, minus the two-way shipping cost.

7. PROCESSING OF PERSONAL DATA (GDPR)

7.1. MONOM, operated by SC OBLIC DESIGN STUDIO SRL, acts as the data controller and processes customers’ personal data in accordance with the General Data Protection Regulation (EU 2016/679) and applicable Romanian legislation.

7.2. Collected data may include: name, address, e-mail, phone number, payment and delivery details, and communication preferences.

7.3. Data is processed for:

  • Order processing and delivery;
  • Invoice issuance and accounting compliance;
  • Customer communication;
  • Marketing communication (with prior consent);
  • Site analytics and improvement.

7.4. External service providers:

Netopia Payments (MobilPay) – payment processing;

GLS / DHL – shipping;

Mailchimp – newsletter delivery;

Google Analytics and Meta Pixel – analytics and advertising.

7.5. Customers have the right to access, rectify, delete, restrict, or object to data processing, as well as data portability and consent withdrawal at any time.

8. INTELLECTUAL PROPERTY

8.1. The MONOM logo, name, images, designs, and content are protected under copyright and trademark laws and remain the exclusive property of SC OBLIC DESIGN STUDIO SRL.

8.2. Any reproduction, modification, or redistribution without written permission is strictly prohibited.

9. GOVERNING LAW AND JURISDICTION

These Terms and all related contracts are governed by Romanian law.

Disputes shall first be resolved amicably, and, failing that, submitted to the competent Romanian courts.

10. PROMOTIONS AND DISCOUNT CODES

10.1. Discount codes cannot be applied to already discounted items.

10.2. Codes must be entered during checkout; post-order application is not possible.

10.3. Promotions and discounts cannot be combined.

11. WARRANTY AND AFTER-SALES SERVICES

11.1. Monom products benefit from a 2-year legal conformity warranty, in accordance with Law 449/2003.

11.2. The warranty does not cover normal wear, damage caused by improper use or accidents, but we can assist with repairs for an unlimited period of time.

11.3. Monom offers refinishing and refreshing services for its products. Details are available on the dedicated Refresh page.

11.4. Chains are covered by a 1-year warranty. Upon request, they can be replaced for a service fee. Please contact us for a personalised price offer.

11.5. In case one earring from a pair is lost, it is possible to order a single replacement piece.

11.6. For repairs or refresh services, the customer is responsible for transportation costs.

11.7. Any defect resulting from manufacturing faults will be repaired free of charge by Monom, regardless of the time elapsed since purchase.

11.8. The first refresh service is free of charge (regardless of the time elapsed since purchase). Subsequent refresh services are subject to a fee, depending on the complexity of the intervention.

12. LIMITATION OF LIABILITY

MONOM makes every effort to ensure the accuracy of information on the website.

However, we cannot be held liable for:

  • minor differences between product images and actual items;
  • interruptions caused by technical or external factors;
  • indirect or consequential losses arising from the use of the site or products.

14. FINAL PROVISIONS
